The patreon really fucked them over because while there is no legal issue with charging users for an emulator which doesn't infringe on any rights of 3rd parties... they were obviously able to easily correlate Yuzu profiting off of Nintendo's games before they were even able to by holding game specific fixes behind a paywall before they were ever even released.. Which means they had access to those games.. and the only way they could have had access to those games before they were officially released is piracy.

So yea, they done fucked themselves.  They used upcoming games and advertised already implemented fixes in the newest yuzu updates for them to get patreon supporters.. aka profit..  instead of waiting for those games to release... and then implementing the fixes sometime later.. like most emulators would do.  That shows a direct intent of enabling piracy.  I bet if it had went to court, Nintendo would have found discord discussions through discovery of the developers talking about all this stuff too... with intent.

They're honestly getting off very lucky, and Nintendo is doing them a favor by settling with them lol.. god damn.

That doesn't matter.  You don't HAVE to... but they incentivized paying for it by holding updates specifically for titles that weren't out yet, behind the paywall. 

Which means they were profiting off of Tears of the Kingdom before Nintendo even did...
